Georgia will let you record the cop, but the officer can demand your physical license even if you have the electronic version on your phone. So maybe bring the plastic card, just in case.
The stuff that is actually true in Georgia
- You must show your license, registration, and proof of insurance. O.C.G.A. 40-5-29, 40-2-40, and 40-6-10. All three. The officer can demand them on the spot. 40-5-29 says the officer may demand physical format even if you have an electronic license. Fine is only $10 if you produce valid license in court, but refusal creates presumption you are driving without a license.
- You can record the officer. Georgia is a one-party consent state (O.C.G.A. 16-11-62 applies to private places). Police performing public duties have no reasonable expectation of privacy. Recording police during a traffic stop is protected by the First Amendment. Just do not interfere.
- They cannot make you wait for a drug dog. Rodriguez v. United States (2015). Once the ticket is written, the stop is over. Georgia courts follow this.
- You can refuse to consent to a search. Fourth Amendment. Say "I do not consent to a search." If they have probable cause (smell, plain view), they can search anyway. But your refusal matters in court.
- Passengers cannot leave without permission. Passengers are detained for the duration of the stop. Do not try to walk away.
The grey area where people get themselves arrested
- "I forgot my license at home." O.C.G.A. 40-5-29(c) says fine is only $10 if you produce valid license in court. But refusal to display creates presumption of violation of 40-5-20. The officer can arrest you for driving without a license.
- "I do not answer questions." True for most questions, but 40-5-29 requires you to display your license. You cannot refuse that one.
- "You cannot search my car." Correct, but Georgia has a broad plain-view doctrine. If the officer sees contraband, they do not need consent. Also, the smell of marijuana alone is no longer probable cause in Georgia after legalization, but the officer may claim other factors.
- "I am driving to a safer location." No Georgia statute gives you this right. The officer may interpret it as evading. Use your judgment, but know the law does not have your back on this.
Things TikTok told you that are wrong
- "Georgia is a constitutional carry state so they cannot disarm me during a stop." Wrong. Terry v. Ohio allows officers to disarm you during a lawful stop if they have reasonable suspicion you are armed and dangerous. Constitutional carry does not override this.
- "If the officer takes longer than 15 minutes, you can leave." There is no magic number. Rodriguez says "reasonably required to complete the mission."
- "You have to let them search if they say they smell weed." Not anymore. Marijuana is legal in Georgia for medical use and decriminalized in some cities. Smell alone is not probable cause. But if they claim to see contraband in plain view, that is different.
- "My electronic license is good enough." Maybe, but O.C.G.A. 40-5-29(b)(1) says the officer MAY demand physical format. If they do, you must comply.
